TERMS OF SERVICE

Welcome to KPFit. These Terms and Conditions govern the use of personal training services provided by Kyle Petricca ("Trainer", "we", "our", or "us"), whether delivered in person, online, or through any digital platform associated with KPFit.

By booking or participating in a training session, you agree to be bound by these terms.


1. Health & Medical Disclaimer

  • All clients must complete a PAR-Q (Physical Activity Readiness Questionnaire) before beginning any training program.

  • You affirm that you are in good physical condition and do not suffer from any known disability or condition which would prevent or limit your participation in physical training.

  • It is your responsibility to consult with a physician before starting any fitness program. The Trainer is not a licensed medical professional and cannot diagnose or treat medical conditions.


2. Liability Waiver

  • You agree to participate in training sessions at your own risk.

  • KPFit and the Trainer shall not be liable for any injuries, illness, or medical conditions that may occur as a result of participation in personal training services.

  • You accept full responsibility for any injuries or damages that may occur during or after training sessions, whether caused by negligence or otherwise.

  • All clients are required to complete an Informed Consent Form before beginning training. This serves as a liability waiver, confirming that you understand the potential risks of physical activity and voluntarily agree to take part.


3. Client Responsibilities

  • You agree to communicate honestly and disclose all relevant health conditions or physical limitations.

  • You must wear appropriate workout attire and footwear during sessions.

  • You are responsible for your own equipment if participating in online sessions.


4. Payment & Booking

  • Payment must be made in advance of sessions unless otherwise agreed in writing.

  • Pricing is clearly stated on the KPFit website and may be updated at any time. Existing clients will be notified of changes with reasonable notice.

  • Packages are valid for a set duration (e.g. 6 or 12 weeks) as outlined at the time of purchase.


5. Cancellations & Rescheduling

  • A minimum of 24 hours' notice is required to cancel or reschedule a session.

  • Sessions cancelled with less than 24 hours' notice will be charged in full and not eligible for rescheduling.

  • Repeated last-minute cancellations may result in the loss of priority booking or termination of services.


6. Lateness Policy

  • If you arrive late to a session, the session will still end at the scheduled time.

  • If the Trainer is late, the missed time will be added to the session or made up at another time.


7. Refund Policy

  • All services are non-refundable once sessions have commenced.

  • If you are unable to complete a package for a valid medical reason, a pro-rata refund may be considered with appropriate evidence.


8. Online & Digital Content

  • Access to online coaching materials, plans, or communication tools (e.g. check-ins, videos, or messaging) is restricted to paying clients only.

  • Sharing content or login details with others is strictly prohibited.


9. Client Progress & Results

  • Results vary depending on the individual. No specific outcomes are guaranteed.

  • KPFit provides guidance and coaching, but effort, consistency, and lifestyle choices remain the responsibility of the client.


10. Confidentiality & Data Protection

  • All personal information shared by clients will be treated as confidential and stored in accordance with GDPR regulations.

  • Your data will not be shared with any third parties without your consent.


11. Termination of Services

  • KPFit reserves the right to terminate services at any time for breach of these terms, inappropriate behaviour, or conduct deemed unsafe or disrespectful.

  • Clients will be notified in writing and any unused sessions may or may not be refunded at the trainer’s discretion.


12. Code of Conduct

  • Respectful, professional communication is expected at all times.

  • Harassment, intimidation, or discriminatory behaviour will not be tolerated.


13. Governing Law

  • These terms are governed by the laws of England and Wales.

  • Any disputes arising will be handled in accordance with UK legal procedure.
